The Problem with Cross-Border Data
When a Canadian political campaign uses an American-built platform, every piece of voter data — names, addresses, contact history, political preferences — is stored on servers subject to U.S. law. Under the USA PATRIOT Act and the CLOUD Act, American authorities can compel access to this data, even when it belongs to Canadian citizens.
This isn't a theoretical risk. Canadian campaigns handle some of the most sensitive personal information imaginable: where people live, how they plan to vote, their political donations, and their interactions with campaign volunteers.
PIPEDA and Provincial Privacy Laws
Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) requires organizations to protect personal information and be transparent about how it's collected, used, and stored. Several provinces have their own substantially similar legislation:
- Alberta: Personal Information Protection Act (PIPA)
- British Columbia: Personal Information Protection Act (PIPA)
- Quebec: Act Respecting the Protection of Personal Information in the Private Sector
Political parties have certain exemptions under PIPEDA for some activities, but these exemptions are narrow. Campaign data management platforms — especially those handling donor information — must still comply with core privacy principles.
The Data Residency Imperative
Data residency — keeping data within Canadian borders — is not just a best practice. For campaigns handling voter lists provided by Elections Canada or provincial election authorities, it may be a legal requirement. These voter lists come with strict terms of use that typically prohibit transferring the data outside of Canada.
What to Look For in Canadian Campaign Software
When evaluating campaign management platforms, consider:
- Server location: Are all servers physically located in Canada?
- Encryption: Is data encrypted both in transit and at rest?
- Access controls: Who can access your data, and under what circumstances?
- Data portability: Can you export your data at any time?
- Compliance documentation: Can the provider demonstrate PIPEDA compliance?
